The U.S. Environmental Protection Agency (EPA) will hold a virtual public hearing on October 1, 2026, to provide the public the opportunity to present comments and information regarding the Agency’s proposed Repeal of Greenhouse Gas (GHG) Standards for Fossil Fuel-fired Electric Generating Units (EGUs).
This action will provide long-term relief to fossil fuel-fired EGUs from GHG emission standards issued under Clean Air Act (CAA) section 111. The EPA is proposing this action on three distinct bases.
First, the EPA is proposing that global climate change concerns cannot satisfy that CAA requirement as it cannot “reasonably anticipate” that GHG emissions from fossil fuel-fired EGUs cause or contribute to the endangerment of public health or welfare because the causal relationship between GHGs and global climate change is too uncertain, conjectural, remote, and convoluted.
Second, the EPA is proposing to find that the appropriate policy response to address global climate change concerns is a decision vested in Congress, not the EPA, and Congress did not decide or delegate to the EPA to decide the Nation’s policy decisions concerning global climate change when it enacted CAA section 111.
Lastly, the EPA is proposing that regulating GHG emissions from U.S. fossil fuel-fired EGUs has no material impact on global climate change effects on public health and welfare and does not justify requiring additional controls to limit those emissions.

The last day to pre-register is September 29, 2026. Please submit a separate registration form for each person attending or speaking. You will receive an email from GHG-EGU-Public-Hearing@rti.org with your unique connection information.
Note: EPA will use your registration information solely for this event. If you register to speak, we will post your name and affiliation as part of the hearing agenda. No other information you provide, such as contact or personal information, will be included on the hearing agenda or shared with any third party.

EPA will take written comment on the proposal until November 2, 2026.
EPA considers all comments equally, whether submitted in writing to the docket or given orally at a public hearing. Each speaker will have 4 minutes to speak. If time allows, EPA will provide an opportunity for public hearing attendees, who did not preregister, to provide oral testimony.
