Mott Million Dollar Challenge - Participant Release and Consent

Overview for Parents and Guardians:

Your student (“Entrant”) is invited to participate in the Mott Million Dollar Challenge (the “Competition”), an entrepreneurship education competition for U.S. based students in grades K–12 sponsored and funded by the Charles Stewart Mott Foundation (“Mott”), and administered by the Network for Teaching Entrepreneurship (“NFTE”).

Mott is a charitable organization whose mission is to promote a more just, equitable and sustainable society.  It is sponsoring and funding the Competition being administered by NFTE, with additional programmatic support from Collaborative Communications and Venture Lab (collectively, with Mott and NFTE, the “Competition Collaborator(s)”).  The purposes of this Consent and Release Form (“Consent and Release”) is to (1) secure permission to use the information about the Entrant referred to below (“Information”), the Entry Submission and the videos and other content submitted by the Entrant (“Content”), and materials created by any of the Competition Collaborators that contain Information about the Entrant or the Entrant’s image or likeness (“Materials”); (2) confirm Entrant’s eligibility to participate in the Competition and Entrant’s acceptance of the Official Rules of the Competition (referred to below) and (3) release Mott, NFTE and the other Competition Collaborators from liability.

Information” means facts/data that identify or refer to the Entrant.  This includes name, school, grade, city, background relating to their interest in innovation and their submission to the Competition, and any other biographical information provided by the Entrant in connection with the Competition. 

To participate in and advance to additional stages of the Competition, students will submit their video entries online using our secure competition platform at https://my.reviewr.com/s2/site/MottMillion for judge’s consideration.

For students under 18 years old, federal and state laws require parent/guardian consent before we can collect or use their information online.

If student is under 13-years-of-age:

As legal parent/guardian I hereby consent to my child’s participation in the Competition, which I acknowledge requires use of the online submission portal as well as the disclosure of my student’s personal information (including the Information).

I also consent to electronic records and signatures under the E-SIGN Act and understand I may request a paper copy.

I understand that:
  1. The website will collect limited information (including the Information) necessary for participation, such as my child’s name, age, grade, state of residence, email, phone number, their teacher’s name, my name and contact details as their parent/guardian, and their video submission.
  2. This information will only be used to administer, judge, and promote the Competition, the Competition Collaborators and will not be shared with third parties, outside supporting the Competition’s success, except for service providers or vendors assisting with any of these tasks or similar tasks.
  3. I may review, correct, or delete my child/ward’s information prior to them submitting their video, and at any time by contacting MottMillion@nfte.com.
  4. I may withdraw consent at any time, and my child/ward will no longer participate. If I withdraw my consent, I understand that my child’s submission will no longer be considered for advancement in the Competition.
Entrant Acknowledgments, Representations and Agreements.
  1. I am a citizen or legal resident of the United States.
  2. Because I am not over the age of 18, this Agreement is signed by my parent or legal guardian and is binding upon them (and upon me, as applicable under law).
  3. My acceptance of these terms is a requirement to participate in the Competition and to be eligible to receive a Prize.
  4. All Information and data provided by me in connection with the Competition and this Consent and Release is accurate and complete.  Each of the Competition Collaborators will rely upon Information I provide.  I will return the full amount of all Prizes I receive upon request if any Information or acknowledgment/representation by me is not true or accurate.
  5. I represent that the Content is my child/ward’s own original creation and does not include any third-party materials, nor has my child relied on artificial intelligence to produce their Entry Submission. 
  6. I have reviewed and agree to be bound by and will comply with the Official Rules of the Competition (“Official Rules”), a copy of which is available here. I will consult the Official Rules for any terms used in this Consent and Release which are not defined in this Consent and Release.
  7. I am solely responsible for the payment of the taxes on any Prizes I receive, and for any insurance or other expenses and costs related to my receipt of any Prizes.
Authorization and License for All Participants Under 18 Years-of-Age

Entrant agrees that each of the Competition Collaborators may use the Information, Content, and Materials (“ICM”) in furtherance of the Competition, to report on and promote the Competition, and to report on their charitable activities.  For example, each Competition Collaborator may publish Materials and excerpts of the Content on its web site and social media platforms and in press releases, annual reports, video and sound recordings that educate the public about their work, and in other materials.  I further understand that this media will be accessible throughout the world and that stories including my child/ward may appear in written, video, electronic, and other forms.  The license is paid up and royalty free, worldwide, perpetual, and for all media now known or later developed, and I understand that no royalty, fee, or other compensation shall become payable to me by reason of such use, whether on behalf of my child/ward or otherwise.  Each Competition Collaborator may use contractors or collaborators in connection with its exercise of this license.

This Consent and Release is given under applicable state law, including (where relevant) California Civil Code §3344 and New York Civil Rights Law §§50–51.

WAIVER AND GENERAL RELEASE
I acknowledge that my child/ward’s participation in the Competition is voluntary and I agree to assume all risks and responsibilities concerning their participation in the Competition, all activities in which they may participate, whether such activities are related to the Competition, such as field trips, or which are unrelated to the Competition, such as informal, recreation, and all travel related to Competition activities or to such unrelated activities (all such related or unrelated activities, the “Activities”).


I hereby waive any right to sue for, and release each of the Competition Collaborators from all claims and causes of action I may have arising from, my participation in the Competition, reliance upon the information I provide, use of the Entry Submission as authorized, and exercise of the license granted above.  This waiver and general release applies to all legal theories (including contract, tort, statutory, legal, and equitable) and all types of damages, expenses, costs, and fees (direct, indirect, compensatory, incidental, consequential, statutory, or other).  It applies to and may be relied upon by each of the Competition Collaborators and their employees, trustees, directors, officers, representatives, agents, attorneys and contractors.
Furthermore, I release and hold harmless each of the Competition Collaborators and their employees, trustees, directors, officers, representatives, agents, attorneys and contractors from any claims of infringement, invasion of privacy, defamation or misappropriation arising from the use of the Information or other ICM for the purposes provided in this Consent and Release.
It is my express intention that this waiver and general release shall bind my child/ward, all members of our family, and all heirs, assigns, executors, and personal representatives.
I waive Section 1542 of the civil code of California:


1542. CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE.  A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
