Mott Million Dollar Challenge - Participant Release and Consent

Overview for Parents and Guardians:

Your student is invited to participate in the Mott Million Dollar Challenge (the “Competition”), an entrepreneurship education competition for U.S. based students in grades K–12 sponsored by the Charles Stewart Mott Foundation (“Mott Foundation”), and managed by the Network for Teaching Entrepreneurship (“NFTE”) (collectively “we,” “us,” “our”).

To participate in and advance to additional stages of the Competition, students will submit their video entries online using our secure competition platform at https://my.reviewr.com/s2/site/MottMillion for judge’s consideration.

For students under 18 years old, federal and state laws require parent/guardian consent before we can collect or use their information online.

If student is under 13-years-of-age:

As legal parent/guardian I hereby consent to my child’s participation in the Mott Million Dollar Challenge (the “Competition”), which I acknowledge requires use of the online submission portal as well as the disclosure of my student’s personal information.

I also consent to electronic records and signatures under the E-SIGN Act and understand I may request a paper copy.

I understand that:
  1. The website will collect limited information necessary for participation, such as my child’s name, age, grade, state of residence, email, phone number, their teacher’s name, my name and contact details as their parent/guardian, and their video submission.
  2. This information will only be used to administer, judge, and promote the Competition, and will not be shared with third parties, outside Mott Foundation, NFTE, and affiliated organizations supporting this competition’s success, except for service providers or vendors assisting with any of these tasks or similar tasks.
  3. I may review, correct, or delete my child/ward’s information prior to them submitting their video, and at any time by contacting MottMillion@nfte.com.
  4. I may withdraw consent at any time, and my child/ward will no longer participate. If I withdraw my consent, I understand that my child’s submission will no longer be considered for advancement.
Media and Publicity Release for All Participants Under 18 Years-of-Age

I hereby provide permission to the Network for Teaching Entrepreneurship (NFTE), Mott Foundation, and their affiliates, (collectively the “Competition Hosts”), to use, reproduce, electronically publish and display my child/ward’s name, photograph, and any information provided by my child/ward in all media including, but not limited to, print publications, online publications, social media, and Internet websites. I understand that this media will be accessible throughout the world and that stories including my child/ward may appear in written, video, electronic, and other forms. I also understand that no royalty, fee, or other compensation shall become payable to me on behalf of my child/ward by reason of such use.

I understand that information provided by my child/ward, including their name, photograph, and information about their submission may be used by Competition Hosts and their partners to promote the Mott Million Dollar Challenge, (the “Competition”). I understand that copies of my child/ward’s completed submission, and materials they provide in connection with the submission, and summaries of such materials (collectively the “Materials”) may be provided to Competition Hosts’ donors and partners to provide examples of the results of the Competition.

By participating in the Competition, I hereby agree to allow and grant use of photographic images, video or audio recordings made by or on behalf of Competition Hosts or its partners, without compensation, and agree to allow my child/ward’s likeness and/or name to appear, and to otherwise be used, in any form of material promoting the Competition.

I grant Competition Hosts permission to use my child/ward’s name, grade, city/state, image, likeness, voice, and submission materials in promotional materials, press releases, websites, and social media related to the Competition.

This release is given under applicable state law, including (where relevant) California Civil Code §3344 and New York Civil Rights Law §§50–51.

Liability Release

I acknowledge that my child/ward’s participation in the Competition is voluntary and do hereby agree to assume all risks and responsibilities concerning their participation in the Competition, all activities in which they may participate whether such activities are related to the Competition, such as field trips, or which are related to the Competition, such as informal, recreation, and all travel related to Competition activities or to such unrelated activities.

I hereby agree not to sue, and to forever discharge, defend, indemnify and hold harmless, and to release the Mott Foundation, Network for Teaching Entrepreneurship (NFTE), and any of their affiliates, subsidiaries, and respective trustees, officers, directors, agents, employees, and likewise all sponsors from and against any losses, costs, damages, actions, causes of action (including, without limitation, attorney’s fees), which my child/ward may suffer or incur as a result of or arising from their participation in the Challenge, all activities related to the Challenge, any activities in which they may participate which are unrelated to the Challenge, and all travel to the Challenge or any related or unrelated independent activities, or from any damage to their personal property, personal injury, or death, as a result of any activity undertaken by me or risk assumed by them thereunder, except to the extent that the same results from the fault or negligence of the Mott Million Dollar Challenge presenters/sponsors and Competition Hosts.

It is my express intention that this Waiver of Liability and Hold Harmless Agreement shall bind my child/ward, all members of our family, and all heirs, assigns, executors, and personal representatives.

Intellectual Property License

I hereby grant the Mott Foundation, Network for Teaching Entrepreneurship (NFTE), and their affiliates, (collectively the “Competition Hosts”), a royalty-free, non-exclusive, worldwide, perpetual license to use, copy, adapt, and distribute my child/ward’s information, and their video submission and any materials submitted in tandem, (collectively “Materials”), for this purpose. I acknowledge that the Competition Hosts will use my child’s Materials for judging and administrative purposes, educational and promotional uses, and archival purposes.

I release and hold harmless Competition Hosts and Competition Hosts’ agents and employees from any claims of infringement, invasion of privacy, defamation or misappropriation arising from the use of the materials or information for the purposes provided herein. I represent that the Materials are my child/ward’s own original creation and do not include any third-party materials, nor has my child relied on Artificial Intelligence to produce their video submission, and I indemnify and hold harmless Competition Hosts and its partners from any third-party claims of intellectual property infringement.

This license is nontransferable and may be revoked in writing after the Mott Million Dollar Challenge closes and before distribution has occurred.

I understand that copies of my completed video submission, and materials provided by me in connection with the submission, and summaries of such materials (collectively the “Materials”) may be provided to NFTE’s donors and partners to provide examples of the results of NFTE’s work.
