Copyright in distance education and research – survey for Public interest institutions (PIIs)

Visionary Analytics, in cooperation with Ecorys, OK Consulting and KEA, is conducting a study for the European Commission to explore the role of copyright in facilitating access to digital collections of public interest institutions (henceforth referred to as PIIs), notably for the purpose of distance education and research. The aim of this study is to understand how copyright facilitates two broad types of interactions:  

  • Access to digital collections of PIIs 

  • Use of these digital collections (for the particular purpose of distance education and research) 

Key definitions used in this survey are: 

  • Public interest institutions (PIIs). The study focuses on PIIs in the cultural heritage, education, and research sectors. Therefore, PIIs must be understood as cultural heritage institutions (e.g., museums, archives, libraries, audiovisual heritage institutions), educational establishments (e.g., primary, secondary, vocational, and higher education institutions), and research organisations (e.g., universities, research institutes, think tanks). 

  • Licensing. We refer to licensing agreements (contracts) by which rightholders authorise the use of their works. These agreements may determine the fees, terms and conditions of use of works. 

  • Copyright exceptions and limitations. We refer to national copyright rules that, under specific circumstances, allow certain uses of copyrighted work without the copyright owner’s permission. 

  • E-lending / e-libraries. We refer to the practice of lending works digitally (e.g. e-books, audiobooks).  

  • Technical protection measures. We refer to tools placed on copyrighted material aimed at preventing unauthorised access or distribution. Examples include passwords, watermarks, time limits on access, among others.
