PWCS McKinney-Vento Eligibility Form

⚠️ Important: This form is used to determine if a student meets the eligibility criteria for McKinney-Vento (MKV) in Prince William County Public Schools (VA).

The federal MKV Act guarantees school enrollment for anyone who, due to a housing loss and lack of alternative housing, does not have a fixed, regular, and adequate nighttime residence. Students living in shelter, transitional housing, hotels/motels, doubled-up or unsheltered may meet the MKV definition of homelessness and have certain educational rights. Determination is made on a case-by-case basis.

Rights and Supports Offered to MKV Eligible Students:

Immediate school enrollment and attendance with enrollment barriers being removed.
- No residency proof needed for purposes of school enrollment. (However, the PWCS MKV Liaison has the option to request information/documentation regarding the student's housing situation as needed.)
- Students can enroll/attend school without producing birth certificate, physical and/or immunization record at time of immediate enrollment.
  - Birth certificate will need to be provided to the school office within 90 days of initial enrollment per PWCS regulation. Schools may request that a Birth Certificate Affidavit be completed at the time of immediate enrollment which is permissible. Schools cannot require that the affidavit be notarized as that can be viewed as a barrier.
  - Immunizations/physical must be produced to the school office within 60 days of initial enrollment per PWCS regulation.
The option to continue attending their school of origin, even if they move outside the school's boundary or secure permanent housing during the school year. The MKV Liaison will determine whether this option is in the student's best interest. School transportation can be requested for students to remain in their school of origin.
Automatic approval for free school meals for the remainder of the school year.
Equal access to the same free, appropriate public education (FAPE).
Participation in extracurricular activities for which the student is eligible. (Note: The MKV program is unable to provide MKV transportation services for extracurricular activities.)
If a student qualifies for MKV Homeless Unaccompanied Youth (HUY), legal custody is not required for enrollment purposes.

Important MKV Information:

The information you provide on this MKV Eligibility Form helps PWCS MKV staff understand the student's housing situation and determine whether the student qualifies for MKV services. We may contact you for additional information if needed. Each student's situation is reviewed individually. MKV status is confidential and protected by FERPA.
If approved, MKV eligibility is valid only for the current school year in PWCS. If a student needs to be considered for the MKV program in a future school year, a new MKV Eligibility Form must be submitted for review. Transportation services do not automatically carry over to the next school year. New applications must be submitted each school year for both eligibility and transportation consideration.
After a student is approved for MKV, we can move forward with a transportation request if one is needed. Please note that transportation has its own separate form that must be completed.

MKV HOMELESS UNACCOMPANIED YOUTH 🎓

A MKV HUY student meets the MKV definition for homeless and the student is NOT residing with his/her parent or court appointed legal custodian due to reasons of hardship. A MKV HUY student might be doubling up with friends/family, staying in a hotel/motel/shelter, couch surfing or possibly unsheltered. A MKV HUY student might have chosen to leave their parents/custodian's home or been asked to leave due to reasons of hardship. Some MKV HUY students might not have the option to reside with their parent/custodian for a variety of reasons/hardships. A HUY student's age can range from early childhood (preschool/headstart) through the age of 21 years old.

IMPORTANT INFORMATION REGARDING MKV ⭐

Determination of homelessness (as defined by MKV) is based on the consideration of the permanence and adequacy of the living situation and is always individually reviewed on a case-by-case basis by the MKV staff.
Any person making a materially false statement regarding residency in a school division may be guilty of a Class 4 Misdemeanor and may be liable to the school division in which the student was enrolled as a result of such false statements for tuition charges, pursuant to the Virginia Code §22.1-5, for the time the student was enrolled in such school division.
The student's MKV status is valid only for the school year in which the student is approved. A student/family must re-apply or contact the PWCS MKV Office to be re-assessed for the next school year's MKV program.The MKV Office begins accepting MKV Eligibility Forms on July 15 of every summer.

- The student(s) has the right to participate in extracurricular school activities; however, the MKV Act does not explicitly require that transportation be provided to/from extracurricular activities. MKV transportation services are only offered according to the school's bell schedule.
- If the student(s) does not maintain regular/on-time attendance, good academic performance and/or exhibit good behavior in school on a regular basis, a Best Interest Determination (BID) meeting might be held to discuss transferring to the school that is zoned for the student's residence, if those concerns would be greatly reduced or eliminated in the local school and if the change would be in the student’s best interest. The parent/custodian/caregiver/HUY student also understands that they would have the right to appeal a decision and the MKV Liaison will supply information if requested.
- That a false claim of homelessness or false residency information could result in the withdrawal of the student from school.
