Nex-Tech Grill Consent Form

in accordance with the Terms of Use (the“Agreement”) set forth herein.

1. The Borrower agrees to report any accident, malfunction, damage or breakdown of the Nex-Tech Grill to Nex-Tech, and further acknowledges that continued use of the Nex-Tech Grill following such accident, malfunction, damage or breakdown shall be at the borrower’s sole risk and liability.
2. The Borrower acknowledges that he/she has been properly trained on the setup and use of the Nex-Tech Grill, and any questions pertaining to such were adequately answered by Nex-Tech before Borrower assumed possession.
3. The Borrower agrees not to use, or permit the use of, the Nex-Tech Grill: a. for any unlawful purpose b. in a careless or negligent manner; and c. without appropriate adult supervision to ensure safety
4. The Borrower agrees to use the Nex-Tech Grill only for the purposes provided herein.
5. Nex-Tech shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown, or malfunction of the Nex-Tech Grill. The Borrower agrees to indemnify and hold harmless Nex-Tech and its owners, agents, affiliates, managers, successors, assigns and personnel (collectively referred to as “affiliates”) from and against any and all claims for loss of or damage to property or injury to person(s), including death, resulting through the use, operation or possession of the Nex-Tech Grill.
6. The Nex-Tech Grill is stored at the Nex-Tech Hays location. Borrower agrees to pick up and return the grill to the Hays location. Borrower agrees to return grill within 24 hours of use to ensure that other reservations are fulfilled.

This Agreement represents the entire understanding and agreement between Nex-Tech and the Borrower with the regard to the subject matter hereof.

We have read this Agreement, fully understand the terms and conditions set forth herein, and warrant that we are authorized to execute this Agreement on behalf of the parties hereto.
