MDUSD Request for Accommodation

The ADA prohibits employee disability related inquiries unless they are job-related and consistent with business necessity.

Such an inquiry is job-related and consistent with business necessity when an employer has a reasonable belief, based on objective evidence, that an employee may pose a direct threat due to a medical condition.

According to the EEOC, based on guidance from the CDC and public health authorities as of March 2020, the COVID-19 pandemic meets the direct threat standard (i.e. there would be a significant harm posed to others by having someone with COVID-19, or symptoms of it, present in the workplace at this current time).

Therefore, there are some specific "yes/no" questions about whether you have been vaccinated.  In order to ensure you do NOT provide any additional possibly disability-related information, these will only be "yes/no" questions with no place/space where you can give additional information (for your own protection) for these specific vaccination questions.

At this time, current guidance and law allows for employers to;
  • mandate temperature taking of employees
  • mandate COVID testing of employees
  • mandate vaccinations of employees
  • and to require proof of vaccination

We are not mandating any of these at this time.  However, as part of the interactive process that you have requested, we are asking a very minimal amount of required questions regarding your current vaccination status (as part of this fact-specific/individual process that you have requested).
