In late June, the U.S. Department of Education (“DOE”) published proposed amendments to the controversial Title IX regulations issued by the previous administration in May 2020. The proposed regulations primarily address how schools must respond to sex-based harassment, including sexual violence.
However, as the DOE proposes amending them, they would also explicitly prohibit other forms of discrimination based on sex stereotypes, sex characteristics, sexual orientation, gender identity, and pregnancy or related conditions, and enhance protections based on pregnancy or parenting status.
The draft rules will be open for public comment for 60 calendar days from their publication in the Federal Register, which we expect to happen imminently. The DOE will consider comments it receives before finalizing and issuing the rules. As the rules address topics of great significance to the UC community, it is critical that the Office of the President provide comments. To ensure those comments are informed by the views of the UC community, the Systemwide Title IX Offices invites your input through this survey.
